A testamentary trust is simply a trust contained within your will that operates much like a trust would operate in your lifetime except that the testamentary trust commences on the death of the will maker who has a testamentary trust in their will.
A binding death benefit nomination (BDBN) binds the trustee of your super fund to make a distribution of your death benefit to person(s) nominated by you in writing. The BDBN must be witnessed by 2 adult persons, and in the case of an industry fund the BDBN has a lifetime of 3 years after which time it lapses. A non binding death benefit nomination (NBDBN) is an expression of your wishes, which the trustee of your fund is not obliged to follow unlike a BDBN.
