We use PEXA, the electronic conveyancing platform service through which most property transactions take place, which allows you to monitor the progress of your sale or purchase via a digital App uploaded to your mobile phone. This App also facilitates the secure exchange of information between the PEXA platform and you. Our expertise as a member of PEXA ensures a seamless, digital journey from start to finish in your purchase or sale.

Some facts about PEXA, you and your solicitor/conveyancer’s engagement with PEXA

PEXA is an electronic conveyancing platform service that is open to solicitors and conveyancers to join as a “subscriber”.
A “subscriber” agrees to comply with rules as promulgated by the Electronic Conveyancing National Law (NSW) (ECNL).
ECNL rules cover such things as how a solicitor/conveyancer is engaged to represent a party who is seller, buyer, mortgagor, mortgagee, lessor, lessee etc.
You authorise your solicitor to represent you on PEXA by completing a Client Authorisation form which is mandatory under the ECNL for a solicitor/conveyancer to be able to act on your behalf.
PEXA App is a mobile app you can download which will provide relevant information on your sale or purchase and allow you to exchange information with the PEXA platform in a safe and secure manner.

What is eConveyancing?
eConveyancing refers to the digitalization and automation of the conveyancing process, which involves the transfer of property ownership from one party to another. With eConveyancing, much of this process is conducted electronically, utilizing secure online platforms (such as PEXA and SIMPLI) after exchange of contracts has taken place. At A W Pitman & Co we are a certified PEXA subscriber and capable of conducting your conveyance electronically.
Do I need to give authority to my solicitor/conveyancer to conduct an e-transaction ?
When you instruct your solicitor/conveyancer to act for you in a property transaction they will require you to complete the Client Authority form that authorises the solicitor/conveyancer to act on your behalf on the electronic platform. The authority you give may be for a single transaction or multiple transactions. If there are 2 or more persons with the same interest (ie as owners) both owners must sign the Client Authority form.
What is the PEXA App ?
The PEXA App is specifically designed for the client of the solicitor / conveyancer. The PEXA App gives the client up to date information on the progress of their e-transaction. The PEXA App is a secure app that can be used to supply information such as the account number you require surplus funds to be deposited to at settlement time. Use of the PEXA App is voluntary. You can download the PEXA App to your Iphone or Android mobile.
What happens at settlement in an E-Conveyance ?
If parties to an E-conveyance have completed their tasks the PEXA workspace created by your solicitor/conveyhancer will be in READY mode, ie ready for settlement at the allocated time. At the allocated time there are 2 parts to the conveyance: (1) document management whereby the documents created by your solicitor / conveyancer (such as Transfers, discharge of mortgage) are processed via the NSW Land Registry; (2) funds disbursement whereby funds are disbursed between banks, vendor, buyers and solicitors.
What record does PEXA provide of the financial settlement ?
PEXA generates its own financial settlement adjustments and financial disbursement statement. The settlement adjustments show what adjustments have been made to the sale price such as council rates, water rates, body corporate levies, land tax etc. The financial disbursements statement will show how funds have been disbursed. If you are the vendor it will show how funds were disbursed to any mortgagee on title, to PEXA, to any third party and to your solicitor. If you are a purchaser, it will also show how the source of funds was applied to buy the property. You can request a copy of the PEXA financial settlement and disbursement statement from your solicitor / conveyancer.
